1 Principles
Use Nella lawfully, safely and with respect for others. The prohibitions below apply to your messages, to the answers you request and to the Creations you produce or publish, with or without an account.
Nella may refuse a request that breaches this policy. Attempting to get around its safeguards (indirect wording, role play, instructions meant to disable them) is also prohibited.
2 Safety of people
You may not use Nella to:
- produce, seek or distribute child sexual exploitation or abuse material, or sexualize minors in any form;
- plan, encourage or glorify violence, terrorism or violent extremism;
- design, build or obtain weapons, including biological, chemical, nuclear or radiological weapons, explosives or illegal firearms;
- encourage suicide, self-harm or eating disorders;
- harass, threaten, intimidate or stalk anyone.
3 Illegal activity and fraud
You may not use Nella for:
- any activity that is illegal in Quebec or in the country where you are;
- fraud, scams, phishing, identity theft or data theft;
- money laundering, counterfeiting, or the sale of illicit goods or services;
- infringement of intellectual property rights, including unauthorized reproduction of protected works;
- sending spam or unsolicited commercial messages in breach of the law, such as Canada’s Anti-Spam Legislation.
4 Privacy and personal information
You may not use Nella to:
- collect, compile or disclose personal information about a person without the right to do so (surveillance, profiling, disclosure of contact details);
- identify a person from their face, voice or other biometric characteristics without a legal basis;
- process sensitive information (health, sexual orientation, opinions, biometric data) in breach of the law;
- process personal information about others that you are not entitled to use.
5 Deception, hate and disinformation
You may not use Nella to:
- produce hateful or discriminatory content targeting a person or group based on protected characteristics;
- impersonate a person or organization, or present AI-generated content as human-made where the law requires disclosure or in order to deceive;
- create or spread disinformation intended to mislead the public, including to influence an election or democratic process;
- produce fake reviews, fake testimonials or fake official documents;
- produce sexually explicit content depicting a real person without their consent.
6 Computer security
You may not use Nella to:
- create, distribute or improve malware (viruses, ransomware, spyware);
- gain unauthorized access to a system, account or data, or help someone do so;
- disrupt a service, including through a denial-of-service attack;
- look for or exploit vulnerabilities in the Service. If you discover one, report it to us in good faith at [email protected].
7 Abuse of the Service
You may not:
- circumvent usage limits or plan restrictions, including by creating multiple accounts or guest accounts;
- access the Service with bots, scripts or other unauthorized automated means, or extract data from it in bulk;
- resell, rent or share access to the Service or to an account;
- attempt to extract the Service’s internal instructions, models or code, or use its answers to develop a competing model;
- overload the Service or interfere with its use by others.
8 High-risk uses
Some uses are allowed only with qualified human oversight. If you use Nella for advice or a decision affecting other people in health, law, finance, insurance, employment, housing, credit or education:
- a competent person must review the output before it is used;
- the people concerned must be told that AI was used, where the law or professional practice requires it;
- no significant decision may be made based solely on an answer from Nella.
Nella must not be used to control critical systems (medical devices, vehicles, infrastructure) where an error could cause injury or serious damage.
9 Creations
Websites and apps created with Nella are subject to the same rules. In particular, you may not create pages that imitate an existing service to collect credentials or payment details, that distribute malware, or that collect personal information without informing the people concerned.
10 Reports and enforcement
To report a breach of this policy or concerning content, write to us at [email protected] with the relevant details.
Depending on severity, we may refuse a request, remove content, issue a warning, restrict access, or suspend or close an account, without refund in case of serious breach, subject to your legal rights. We report child sexual exploitation material and serious threats to the competent authorities, as the law requires or permits.
